Definitions

Seller/Supplier: This term refers to individual sellers or companies registered on the “Sabriel E-Commerce” website to offer their products for sale to buyers.

Buyer/Client: This term is used to refer to individuals who purchase products or services from suppliers through the “Sabriel E-Commerce / Sabriel Agency” website.

User: This term collectively refers to any individual or entity accessing or using the “Sabriel E-Commerce / Sabriel Agency” website. Users can include both sellers and buyers, as well as any other person or entity visiting or interacting with the online platform.

Sabriel E-Commerce/Sabriel Agency/Sara Casciaro/Administrators/Team: These terms collectively refer to the owner of the “Sabriel E-Commerce / Sabriel Agency” website, identified as Sara Casciaro. This team is responsible for providing the platform, graphic and web design services, and is also the main supplier of Sabriel brand products. Currently, the company is exclusively led by a single owner without any other administrators or team members.

“Website” or “My/Our website”: refers to our website as a whole, encompassing all pages, content, and functionalities accessible through the specific domain or related web address. When we mention “My/Our website,” we are referring to the website that we own or manage. By using the term “Website” or “My/Our website” in our Terms and Conditions, we are referring to all constituent parts and content present on the platform.

1. Registration and Account

1.1 Registration and access for customers can be done through either Facebook, Google, or the original registration offered on our website.

1.1.1 Only the registration on the original website will provide the option to register as sellers as well. During registration, users can sign up by entering their information as on any website. However, by clicking on the “Register as a Seller” checkbox beneath the user registration, another section of registration will appear. Here, users can register as sellers by providing additional information.

1.2 Your request constitutes an offer directed to Sabriel E-Commerce / Sabriel Agency and the sellers to enter into a sales contract. Once an order is placed on our website, you will receive a confirmation communication in which we will provide you with the order details. This confirmation may be sent via email or other means of communication. However, it’s essential to underline that this confirmation communication does not equate to the acceptance of your offer. Its sole purpose is to confirm that the order has been received and processed. The sales contract is considered concluded only when the ordered product is dispatched, and we provide you with a second communication confirming the shipment. This way, we keep you informed about the order status and its progress.

1.3 You are responsible for your account credentials and personal information. Never disclose your personal information to unknown customers or even administrators. Administrators will never ask you for sensitive data such as passwords or banking information like card numbers, CVC, and expiration dates. In the event of such actions, Sabriel E-Commerce / Sabriel Agency will disassociate itself from any responsibility.

1.4 You are responsible for entering accurate data in your account, such as your name, surname, email address, billing addresses, and any other necessary information for the proper functioning of the platform or for item shipments. Otherwise, Sabriel E-Commerce / Sabriel Agency and the vendors will not assume responsibility for incorrect shipments or other issues, and the shipping and item costs will not be refunded.

1.5 Your information will be used and, in certain cases, shared with third parties for the proper functioning of the services and the platform, and only for the purposes outlined as specified in our Privacy Policy.

1.6 Your personal or non-personal information may also be collected for the purpose of protection against threats and to prevent hacking of the website and our profiles.

1.7 Your account is a private space, and apart from the strictly necessary information collected by third parties and Sabriel E-Commerce / Sabriel Agency for the reasons outlined in our privacy policy, no other user can enter your profile voluntarily to view your private information.

2. Selling Products and Services

2.1 When a customer places an order through our platform, this action constitutes a formal offer to purchase the selected product or service. Please note that the acceptance of this offer by us and the sellers will only occur when an order confirmation is sent to the customer. We reserve the right to accept or decline any purchase offer at our discretion. Any payment made by customers for orders that have not been accepted will be refunded in full.

2.1.1 You agree to receive invoices in electronic format. For further information about electronic invoices and instructions on how to obtain a paper copy of the invoice, you can contact us through the contact details provided at the beginning of this page.

2.1.2 Deliveries will normally take place within 1 working day from the purchase. Sellers must commit to adhering to this process to ensure smooth, fast, and convenient shipping for our customers.

2.1.3 The shipping time varies depending on the seller, logistics, and the destination country. In normal cases, shipping should reach its destination within 2 to 7 working days. To ensure we’re covered for any potential issues, we adopt a shipping policy of up to 30 days as required by law, including for France and Spain. If the product doesn’t arrive within 30 days due to the fault of Sabriel E-Commerce / Sabriel Agency or the seller, the full amount of the product and shipping will be refunded. If the issue is related to logistics, we are not liable, and Sabriel E-Commerce / Sabriel Agency and the sellers will not reimburse the expenses. The responsibility for reimbursement in such cases lies with the logistics provider, in accordance with their refund policies.

2.2 The prices of products and services are clearly specified on our platform. During the checkout process, additional VAT will be displayed, as the prices are indicated excluding VAT. Payment processing will take place through the available options, including PayPal and Stripe. We accept payments in the currency shown at the time of checkout. Please note that depending on the chosen payment method, additional charges or fees may apply. By using PayPal and Stripe, you accept their respective terms of use.

2.2.1 Both Sabriel E-Commerce and the sellers can provide and create discount coupons/vouchers for customers. Sellers will be responsible for creating appropriate and compliant discount coupons, refraining from giving out coupons without a valid reason, such as being family members, relatives, or friends of the seller. We will have access to and monitor all discount coupons provided and created by the sellers. In case of fraudulent use or violations of our policies, we reserve the right to close or suspend the seller’s account. Sellers are accountable for creating vouchers usable only once per customer and not more.

2.2.2 Creating duplicate accounts to take advantage of a voucher or discount coupon more than once is strictly prohibited. We will have access to this information, and in the event that such fraudulent use occurs, we reserve the right to close or suspend the account and cancel the order. The canceled order will be refunded by the relevant seller upon request from Sabriel E-Commerce / Sabriel Agency.

2.3 Digital products will always be available in unlimited quantities. For physical products, availability will be indicated by the quantity displayed under the item. In the event that a physical product is no longer available after purchase, both Sabriel E-Commerce / Sabriel Agency and the Sellers will take responsibility for providing a full refund of the product.

2.4 In cases where digital products are sold, both Sabriel E-Commerce / Sabriel Agency and each individual seller commit to providing clear and understandable documentation that informs users about the intellectual property rights related to such products. This documentation specifies how customers can use the purchased digital products. Each digital product will be accompanied by detailed instructions regarding permissible usage and any applicable restrictions. Users are encouraged to carefully read this information before using the digital product.

2.5 While we strive to provide excellent products and services, we want to emphasize that we cannot be held responsible for any inconvenience or loss arising from the use of our products. It’s important to note that if a product is lost during shipping, this is not attributable to either Sabriel E-Commerce / Sabriel Agency or the Sellers, but rather a logistics issue with the shipping service.

2.6 Measures will be taken against fraudulent activities, such as the use of false or unauthorized payment information, unauthorized use of products in violation of usage guidelines, attempts to manipulate prices or offers, providing false or inaccurate shipping, payment, or contact information, unauthorized use of images or descriptions provided by sellers, and any other deceptive actions.

2.7 We take full responsibility for products and services offered by Sabriel E-Commerce / Sabriel Agency, while for services offered by vendors, they must take on their own responsibilities and adhere to our site’s policies.

2.8 In addition to the previous information, it’s important to further elaborate on intellectual property rights, including the use of trademarks, logos, and content. It is emphasized that products sold by Sabriel E-Commerce / Sabriel Agencyare wholly owned by Sabriel E-Commerce / Sabriel Agency, whereas products sold by Sellers are the exclusive property of the Sellers themselves, their suppliers, and third parties. Please take note that advertising or selling products from our site, which are not products of third parties but of personal production, on other websites or in other countries without our prior authorization is strictly prohibited. This includes unauthorized use of trademarks, logos, or content. Such action may result in legal consequences at the discretion of Sabriel E-Commerce / Sabriel Agency. We encourage our users to respect intellectual property rights and act in accordance with the applicable laws. Graphics, such as logos and trademarks of Sabriel and suppliers, business cards, and any other elements, are exclusively the property of their respective owners.

2.9 In Sabriel E-Commerce / Sabriel Agency, the sale of illegal products such as drugs, weapons, and any other items prohibited by law is strictly prohibited and punishable. Currently, the sale of food items, tobacco, cigarettes of any kind, and alcoholic beverages is also prohibited on Sabriel E-Commerce / Sabriel Agency.In the event of a violation, Sabriel E-Commerce / Sabriel Agency reserves the right to remove the product without prior notice from the seller and to suspend or close the seller’s account.

3. Refund and Warranty Policy

3.1 Sellers are required to adhere to our site’s policies; failure to do so may result in the suspension or closure of the account due to the violation.

3.2 Both digital and physical products can be refunded within 30 days of receiving the product. However, there are some situations in which a refund is not possible. These exceptions include:

    • Products that cannot be returned for reasons of health or hygiene and whose seal has been broken after delivery or which have been mixed with other goods inseparably after delivery.
    • Audio or video recordings or computer software in sealed packaging, if the seal has been broken after delivery.
    • Customized or personalized products tailored to the customer’s personal needs.
    • Products that can deteriorate quickly or have an imminent expiration date.
    • Services that have been fully provided (e.g., the use of a music service) and if you have expressly agreed that we can begin providing the service.
    • Delivery of newspapers, periodicals, or magazines, except for subscription contracts.

3.4 All services provided by Sabriel E-Commerce / Sabriel Agency related to graphic design and websites are non-refundable, as we commence the service only upon the client’s initiation. The services offered by Sabriel E-Commerce / Sabriel Agency require expertise, professionalism, and time for production. Once a service has been initiated, it cannot be refunded or reconsidered.

3.5 To return a physical or digital product, you can go directly to “My Profile,” navigate to the “My Orders” section, select the order for refund, and click on “Refund” to follow the procedure.

Every product from Sabriel E-Commerce must come with a 2-year warranty, including products sold by sellers on the site. This warranty covers the following cases:

    • If the product is not suitable for the intended use as defined in the contract.
    • If the product is not suitable for normal use.
    • If the product’s quality significantly differs from the typical quality of goods of the same type, including issues related to type, quantity, quality, functionality, compatibility, and interoperability.
    • If the product lacks the features promised by the seller or manufacturer in their public statements, especially in advertising.
    • If necessary accessories, including assembly and installation instructions, are not provided.
    • If assembly or installation is required and is performed improperly.
    • If, for products with digital elements or digital content or digital services, updates are not provided during the specified period.

Additionally, you have the right to request a price reduction or to cancel the contract in the following cases:

    • If the seller refuses to perform a repair or replacement of the product because it is impossible or requires a disproportionate effort.
    • If the seller fails to repair or replace the product within a reasonable time, or if the issue persists despite one attempted repair (in consumer purchases).
    • If, in consumer purchases, it is evident that the seller is not acting correctly.
    • If there are specific circumstances that, when weighed in your interests and those of the seller, justify immediate termination.

3.6 In the case of a refund, the customer agrees to pay the shipping costs out of their own pocket, and after the product arrives, Sabriel E-Commerce will refund the full product and shipping price for Sabriel products, and sellers will refund for all other products.

4. Electronic Communications

When you purchase products or use services, or send us emails, text messages, or other communications from your computer or mobile device, you are communicating with us electronically. We will communicate with you electronically through various means, such as email, text messages, and live chat. For contractual purposes, you agree that all consents, notices, releases, and other communications that we provide to you electronically, to the extent not required to be in writing, shall be considered valid and effective.

5. Content and User Reviews Content Moderation

5.1 Offensive content and censored words will be carefully reviewed before publication. In the event that a user submits a comment directly containing offensive or non-compliant language according to our standards, the comment will be automatically removed or obscured by an integrated system. Subsequently, it will be re-evaluated by the administrator before final publication.

5.2 You grant to Sabriel E-Commerce / Sabriel Agency the following rights:

    • Non-exclusive and royalty-free rights to use, reproduce, publish, make available, and modify the content worldwide on any media, including the right to sublicense to third parties.
    • The right to use the provided name in connection with such content.

5.3 Visitors are allowed to share reviews, comments, and other types of content, provided that such content is not illegal, obscene, offensive, threatening, defamatory, or invasive. Please note that such content may include elements such as computer viruses, political promotions, advertisements, chain letters, unwanted messages (spam), offensive language targeting other countries, and more.

5.4 You declare and warrant that you possess all necessary rights or control over the content of your creation that you will provide; that, as of the date of provision, such content will be free of errors; and that the use of such content will not violate any applicable terms or policies of Sabriel E-Commerce / Sabriel Agency and will not cause harm to individuals or entities. Additionally, you agree to indemnify and hold Sabriel E-Commerce / Sabriel Agency harmless from any claims brought forth by third parties in relation to such content.

6. Disclaimer of warranties

6.1 No Warranty of Error-Free or Uninterrupted Service Sabriel E-Commerce / Sabriel Agency does not provide any warranty regarding the absence of errors or interruptions on the website and does not guarantee the correction of any defects.

Sabriel E-commerce / Sabriel Agency  is not liable for any direct, indirect, incidental, consequential, or punitive damages associated with the use of the website.

7.1 During the registration process, both customers and sellers are required to check two mandatory acceptance boxes in order to complete the registration. Users confirm that they have read and agreed to the Terms and Conditions, as well as the Privacy Policy. Additionally, they agree to take on all responsibilities outlined in our site’s policies. In case of non-compliance with these policies, we will take strict measures, and we will not be held responsible for any damages suffered by users.

8. Indemnification

8.1 By using the website and violating these Terms and Conditions and the Privacy Policy, users agree to indemnify and hold Sabriel E-commerce / Sabriel Agency harmless from any claims, losses, or damages (including legal fees).

9. Interaction between customers and sellers

9.1 Sabriel E-Commerce / Sabriel Agency allows third parties to list and sell their products on the website. However, it is important to clarify that all products that do not belong to the Sabriel brand are not considered part of Sabriel E-Commerce / Sabriel Agency. The services offered, such as website creation, graphic design, and advertising support, are exclusively linked to Sabriel E-Commerce / Sabriel Agency.

Although Sabriel E-Commerce / Sabriel Agency facilitates transactions within the marketplace, it does not act as either a buyer or a seller for items that are not Sabriel-branded. Sabriel E-Commerce / Sabriel Agency provides a platform for buyers and sellers to negotiate and conclude transactions. Consequently, the contract resulting from the sale of such third-party items is exclusively between the buyer and the seller. Sabriel E-Commerce / Sabriel Agency is not a contractual partner and, therefore, assumes no responsibility in relation to this contract.

Furthermore, it is crucial to emphasize that Sabriel E-Commerce / Sabriel Agency does not act as a representative of the seller. The responsibility for the sale of the products, any claims by the buyers, and all other matters related to the contract between buyer and seller falls entirely on the seller.

10. Sabriel E-Commerce / Sabriel Agency  Responsibility

10.1 At Sabriel E-Commerce / Sabriel Agency, we are steadfast in ensuring a seamless shopping experience and minimizing errors on our website. However, we acknowledge that due to the inherent nature of the internet, absolute absence of issues cannot be guaranteed. Access to the website may be interrupted for maintenance, repairs, or the introduction of new features. We are actively working to keep such interruptions as brief as possible.

It is important to emphasize that Sabriel E-Commerce / Sabriel Agency responsibility arises in cases of essential obligation violation, where the breach jeopardizes achieving the contractual purpose or adherence is pivotal for proper contract execution, and the customer regularly relies on it. In these situations, our liability is limited to foreseeable and typical damage resulting from the contract, not encompassing other circumstances.

Nonetheless, it is crucial to clarify that the aforementioned limitations of liability do not apply in cases of personal injuries, harm to health, or defects arising after assuming a warranty for product quality. Furthermore, these limitations do not apply to intentionally concealed defects. Liability under product liability laws remains unchanged.

11. This website is not suitable for minors

11.1 We do not offer products for sale by minors. Our children’s products can only be purchased by adults, as already specified in our privacy policy. If you are under 18, you can use our website only with the involvement of a parent or guardian.

12. Customs Duties

12.1 Depending on the territory to which we are shipping, additional fees imposed by Customs may apply. These expenses are not covered by us, nor do we have access to information regarding the added Customs fees. These charges will be borne by the customers.

13. Seller Fees and Other Information

13.1 During the registration process as a seller, it is mandatory to accept the Terms & Conditions and Privacy Policy. If a seller registers without accepting these terms, their registration will not be approved by the administrator.

13.2 The Seller, in order to sell on the platform, agrees to have provided accurate company information and VAT details. The Seller also accepts that Sabriel E-Commerce / Sabriel Agency may conduct an inspection before granting approval for the sale of physical or digital products on the website.

13.3 Sabriel E-Commerce / Sabriel Agency will provide the Seller with the selling platform in exchange for a 9% commission on the selling price of each product. The 9% commission that Sabriel will withhold from the Seller will be processed automatically. For each product sold, the Seller agrees that Sabriel E-Commerce / Sabriel Agency  will automatically withhold 9% of the sale amount.

14. Available payment methods

14.1 Only 2 secure payment methods will be available on our website, as mentioned in paragraph 2.2: payment through PayPal and payment through Stripe.

After that, proceed to “Pay Now” and follow the steps on the Checkout page, which will be divided into 3 sections to facilitate the customer’s purchase. Always remember to provide accurate information; it will be the responsibility of the customers. In case of false information, neither Sabriel E-Commerce nor the sellers will assume responsibility, and the purchased product and shipping costs will not be refunded.

All disputes or controversies arising from these Terms and Conditions or the use of our services shall initially be subject to negotiation and mediation within a period of 30 days (if permitted by law) from the notification of a dispute, in order to seek an amicable resolution.

If the applicable law requires a different jurisdiction or a specific court for dispute resolution, the parties consent to submit the dispute to the jurisdiction and law required by the applicable law in force at that time.

In the absence of mandatory legal provisions, the parties consent to submit any dispute exclusively to the jurisdiction of the courts of the Federal Republic of Germany, specifically the competent court for the jurisdiction of Bavaria.

You irrevocably accept the jurisdiction of such courts for any legal action, proceeding, or controversy.
